LA TUTELA DELL’AMBIENTE IN COSTITUZIONE. SPERANZE DI RIFORMA
Starting from the recent intention of the Italian Prime Minister to include the environmental protection in the Italian Constitution, the article speaks about the lack of environmental protection in the Italian Constitution and analyzes the articles 2, 9 and 32 that – with an extensive interpretation – have guaranteed and guarantee an indirect constitutional protection to the environmental theme. An overview is given of the environmental safeguards present in more recent constitutions than the Italian one and in reformed constitutions of different geographical areas (South America, Africa, India, main European Countries), more in the European Treaties. At the end the text presents an author’s proposal to reform the Italian Constitution to insert the environmental protection both in the Fundamental Principles (art. 9) and in the First Part concerning Rights and Duties of citizens (art. 32 and 54).

wird regelmäßig sogar Unterschlagung bejaht. Lässt er den Gewahrsamswechsel geschehen, ohne sich darüber bewusst zu sein,
dass eine Gewahrsamsverschiebung zu seinen Lasten stattfindet, liegt Diebstahl vor.
Ist das Opfer mit einem Gewahrsamswechsel aufgrund seines frei
gefassten Willensentschlusses einverstanden (gleichwohl täuschungsbedingt), liegt Betrug vor.
Aufgrund des Irrtums muss der Getäuschte eine Vermögensverfügung vornehmen.
Aus der Vermögensverfügung muss ein Vermögensschaden resultieren. Bezieht sich der Betrug lediglich auf einen geringwertigen Vermögensschaden (die Grenze
wird - wie beim Diebstahl - in der Regel bei 50 € angesetzt), so ist nach § 263 Abs.
4 StGB zur Verfolgung der Tat unter Umständen ein Strafantrag erforderlich.
Die Versuchsstrafbarkeit des Betruges folgt aus § 263 Abs.
2 StGB. Regelmäßig liegt eine Wegnahmehandlung im Sinne des § 242 StGB
(Diebstahl) vor, da das Opfer sich unter dem Eindruck einer Zwangslage lediglich beugt.
Unabhängig von der Frage eines tatbestandsausschließenden Einverständnisses des Tankstellenpächters (Wegnahmehandlung beim Diebstahl?) und der zivilrechtlichen Fragen um den gesetzlichen Eigentumsübergang
kraft Vermischung des Treibstoffs im Tank einerseits sowie vorliegenden Eigentumsvorbehaltes andererseits, wird Betrug angenommen. Beim Smartphone
lässt sich der Jugendschutz bereits schwieriger sicherstellen. Bereicherungsabsicht.
Dies wird bejaht, wenn Absicht bezüglich der Erzielung eines Vermögensvorteils vorliegt; dieser muss stoffgleich
zum Vermögensschaden des Opfers sein; will heißen, dass der Täter den Vorteil unmittelbar aus dem Vermögen des Geschädigten anstrebt,
der Vorteil bei ihm mithin die Kehrseite des Schadens
beim Geschädigten ist. -
